May 29, 2002- RIVERSIDE, California, (CWNews.com) - A federal court on Tuesday found that a California county violated a nurse's constitutional rights when she was fired from the county hospital for refusing to dispense the abortifacient "morning-after" pill.
The federal jury found that Riverside County violated Michelle Diaz's First Amendment rights of free speech and freedom of religion and failed to reasonably accommodate her religious beliefs. Diaz was fired from her job as a nurse at the Riverside Neighborhood Health Center in June 1999. Diaz said she was fired after she told her supervisor that her religious beliefs prevented her from dispensing medicines that cause abortion. She said she received her termination notice after talking to the press about the controversy over the pill.
"This is a tremendous victory for our client and for
all health care professionals who want to do their jobs without violating their
consciences and religious beliefs," said Francis J. Manion, Senior Counsel of
the American Center for Law and Justice, which represented the nurse. "This
verdict sends a very clear message that conscience rights of employees must be
respected by employers everywhere."
